Terms and Conditions
for Costume Photography

WHAT’S INCLUDED
With our Costume Photography Package, you will receive one (1) photoshoot session for up to 30 minutes, one (1) social media ready Image with a creative, personalized background customized to match your child’s costume, and one (1) professional print Canvas of the final Image. 

IMAGES & RESOLUTION
We will provide you with one (1) 1,000px x 1,000px Image to share with friends, family, or on social media. Smart Man Media will not deliver RAW files unless agreed upon beforehand. If you would like the full resolution Image, an additional fee of $49.95 will be applied. The Image will be printed on the Canvas from full resolution. You may choose to receive the full resolution Image instead of the printed Canvas at no additional fee or cost.

CANVAS PRINT 
Smart Man Media will have the final image printed on a 36”H x 24”W museum-quality Canvas (aspect ratio 3:2). The Canvas included will be printed on a thin wooden frame (0.75”) with a black or white border on the sides. If you prefer a different size for your Canvas or other printing special request, such as a thicker Canvas frame (1.5”) or lamination, please let us know prior to the photography session. Additional fees may apply. Smart Man Media uses a third party for printing and is not liable for any damages, unsatisfactory print details, or any other issue involving the print(s). 

DELIVERY & TIMELINE
Within 7-10 business days from the date of the photography session, Smart Man Media will finalize the creative artwork and send the final Image to the email address you provided at the time of booking. If you would like your Image sooner, Smart Man Media will do its best to accommodate you, but rush fees may apply. 
Shipping for the Canvas will take an additional 7-10 business days. Total turnaround time from the date of the photoshoot is 3-4 weeks for the final printed Canvas. Expedited orders are available; rush fees will apply. 

COPYRIGHT & USAGE
Smart Man Media shall own the copyright for all Image(s) created and may use the work for advertising and self-promotion, including, but not limited to, use on the Smart Man Media website, newsletters, advertising & marketing materials, and social media. Usage outside the bounds of this agreement will require your consent. You are not permitted to sell any Image(s) by Smart Man Media.

IMAGE REVISIONS 
Once you receive your final Image, if you would like any changes or revisions made to the final Image(s), an industry standard graphic designing fee will apply at $79/hour. This includes, but is not limited to, color adjustments, print size (aspect ratio) changes, and other design elements.

PAYMENT & REFUNDS
A nonrefundable 50% deposit of the total balance is due at the time of booking. The remaining balance is due 24 hours before the scheduled time of the photoshoot. We will attempt to contact you for payment; however, if you do not respond or contact us 24 hours prior to your appointment to arrange payment, we will cancel your photo session and retain the initial deposit. Please see the paragraph below titled Cancellation & Rescheduling for more information.

GENERAL STUDIO GUIDELINES
All children under the age of 18 must be accompanied by a parent or guardian. Children may not be left unattended at any time. Parents accept full responsibility for the actions and safety of the child/children during the photoshoot. Up to 3 immediate family members are welcome to join the photography session; however additional guests are not permitted at this time.
 
NOTICE OF DELAY
In the event that you are unable to make it on time, you are required to notify Smart Man Media as soon as possible by calling us at 1-888-402-2296. If you will be more than 15 minutes late to the scheduled time of photoshoot, Smart Man Meda reserves the right to reschedule the photoshoot and you may be subject to a last-minute rescheduling fee of $50.

CANCELLATIONS & RESCHEDULING
All deposits are nonrefundable. We request 24 hours notice wherever possible to cancel or reschedule. If you cancel your photoshoot, you will have 30 days to reschedule. If you do not reschedule within 30 days, you agree to forfeit the paid deposit. You will be subject to a $50 last-minute rescheduling fee if you cancel or reschedule on the same day as your scheduled photo session.

BACKUP AND STORAGE OF FILES
Smart Man Media will store all Image(s) and files relating to the Image(s) for a period of 90 days. After this 90 day period, Smart Man Media reserves the right to delete and purge any files or Image(s). Smart Man Media will continue to own the copyrights to all Image(s) regardless. Smart Man Media shall not be held responsible if any files or Image(s) get deleted before this 90 day period due to a fire or other casualty, strike, act of God, or any other event that is out of the control of Smart Man Media.

FAILURE TO PERFORM
If Smart Man Media cannot perform the photoshoot due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to illness, Smart Man Media will notify you immediately and attempt to reschedule the photoshoot. If an agreement regarding rescheduling cannot be reached, the original paid fee may be refunded at the sole discretion of Smart Man Media. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of Smart Man Media.
